Terms of Service

These Terms govern your use of the website autopmta.net, the Auto PMTA Configurator, and any services provided by AutoPMTA LLC ("we", "us", "autopmta"). By using the site or purchasing the Configurator or a service, you agree to these Terms. If you do not agree, please do not use them.

1. What we provide

autopmta provides tooling and professional services for deploying and operating self-hosted email infrastructure. This includes the Auto PMTA Configurator — a one-time license (currently €799) for software that installs, configures and helps you operate a sending platform — and optional services such as setup, migration, managed deliverability, audits and related work. The Configurator supports PowerMTA 6.0r2, PowerMTA 5.x, and KumoMTA.

2. The sending engine is yours

We are tooling and a service provider, not a software reseller. Where you use PowerMTA, it is commercial software and you must hold your own valid license from its vendor or an authorised reseller; we install and configure your licensed copy but never include, bundle, resell, "null" or crack it. Where you use KumoMTA, it is open-source software licensed by its authors under its own terms (Apache 2.0), at no cost. You are responsible for complying with the license of whichever engine you run.

3. Acceptable use

Our tools and services are strictly for legitimate, permission-based ("opt-in") email. You agree not to use them, and we will not knowingly assist, to:

• send unsolicited bulk email (spam) or mail to purchased, scraped or non-consented lists;
• run nulled, cracked or otherwise unlicensed commercial software;
• evade spam filters, falsify headers, or disguise the origin of mail;
• send unlawful, fraudulent, deceptive, or harmful content; or
• violate any applicable law, including anti-spam, data-protection and consumer-protection rules.

We may decline or discontinue work where we reasonably believe use falls outside these rules. There is no "unlimited" sending and no guarantee of volume — deliverability depends on your reputation, list quality and compliance, not on the software.

4. Payment, currency and taxes

Prices are stated in euros (EUR) and are payable as described at the point of purchase. Prices may be exclusive of applicable taxes such as VAT, which will be added where required. Specific payment, invoicing and tax terms are set out at checkout or in your service agreement. [REFUND / CANCELLATION POLICY — to be completed.]

5. Third-party software and trademarks

PowerMTA is a product and trademark of its owner (Bird, formerly SparkPost / Port25); KumoMTA, Postfix, Halon and other named products are the property of their respective owners. autopmta is independent and not affiliated with, endorsed by, or sponsored by any of them. References are for identification and comparison only.

6. No deliverability guarantee

We will apply professional care, but we do not and cannot guarantee inbox placement, specific delivery rates, sender reputation outcomes, or that any mailbox provider will accept your mail. Those depend on factors outside our control, including your sending practices, list quality, content and history.

7. Warranties and "as is"

Except as expressly stated and to the fullest extent permitted by law, the website, tools and Configurator are provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

8. Limitation of liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising out of or relating to your use of the site, tools or services. Our total aggregate liability for any claim is limited to the amount you paid us for the item or service giving rise to the claim. Nothing in these Terms excludes liability that cannot lawfully be excluded.

9. Your responsibilities and indemnity

You are responsible for your own servers, IP addresses, domains, licenses, content and recipients, and for complying with all laws that apply to your sending. You agree to indemnify us against claims arising from your misuse of the tools or services or your breach of these Terms.

10. Intellectual property

The website content, the Configurator software and our documentation are owned by us or our licensors and are protected by intellectual-property law. Purchasing the Configurator grants you a license to use it as described; it does not transfer ownership. You may not redistribute, resell or reverse-engineer it except as permitted by law.

11. Termination

We may suspend or end access to the site or a service if these Terms are breached, in particular the acceptable-use rules. Provisions that by their nature should survive termination — including sections 5 through 10 — will survive.

12. Changes to these Terms

We may update these Terms from time to time. The "last updated" date above reflects the current version, and continued use after a change constitutes acceptance of the updated Terms.

13. Governing law and disputes

These Terms are governed by the laws of the Netherlands, and the courts of Amsterdam, the Netherlands have jurisdiction, without prejudice to any mandatory consumer protections in your country of residence.
